Works created by Linda Ferentchak and Financial Communications become the property of the client once full payment is made. The exception is when the work appears under Linda Ferentchak's byline, in which case she retains copyright on the work. Copyright protects original works of authorship. A trademark protects words, phrases, symbols, or designs identifying the source of the goods or services of one party and distinguishing them from those of others. The Thoughtful Investor is a trademarked newsletter name, registered to Linda Ferentchak and Financial Communications Associates, Inc.

A written work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device. It is advisable to register a work if there is the potential that the copyright owner might wish to bring a lawsuit for infringement of a U.S. work. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. If registration occurs within five years of publication, it is considered prima facie evidence in a court of law.
